TERMS AND CONDITIONS
These Terms and Conditions apply to all work undertaken by Packshot Bureau Limited (“we,” “us,” “our”), a company registered in England and Wales, providing commercial product photography services. By commissioning our services, you (“the Client”) agree to the terms outlined below.
1. Definitions
“Images”: All photographic, digital, or visual content delivered by Packshot Bureau Limited.
“Usage Licence”: The rights granted to the Client to use the delivered images for specific purposes.
“Shoot Date”: The confirmed date of the photography session.
“Final Files”: The final edited image files supplied to the Client after post-production.
2. Copyright & Usage
All images remain the intellectual property of Packshot Bureau Limited unless expressly agreed otherwise in writing.
Usage rights are granted only upon full payment and are non-exclusive, non-transferable, and limited to the agreed use.
Any use beyond the original scope requires prior written approval and may incur additional licensing fees.
We retain the right to be credited where appropriate and assert our moral rights under the Copyright, Designs and Patents Act 1988.
3. Booking & Cancellations
Bookings are confirmed once a written quotation or proposal is accepted by the Client.
Cancellation within 10 business days of the shoot incurs a 20% fee. Cancellation within 48 hours incurs a 50% fee.
Rescheduling is subject to availability and may incur a rebooking fee.
4. Payment Terms
Unless otherwise agreed in writing, payment is due within one working day of delivery.
Watermarked images will be provided upon project completion. Final, unwatermarked files will be released once full payment has been received.
Usage rights are not granted — and image use is not permitted — until full payment is received
Late payment will result in the following consequences:
Immediate revocation of all image usage rights until the outstanding balance is settled in full.
Statutory interest charged daily at a rate of 8% per annum above the Bank of England base rate, in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
A fixed late payment fee of £45 (excluding VAT) per communication issued in pursuit of the overdue invoice, to cover credit control, administration, and collection costs.
Removal of any discounts or promotional rates applied to the original invoice; the full standard rate will become immediately due.
We reserve the right to suspend all current and future services, withhold delivery of any outstanding work, and initiate legal proceedings or debt recovery action without further warning.
If the Client defaults on payment, all outstanding invoices become due immediately, regardless of original due dates.
The Client is responsible for any legal or collection costs incurred in the recovery of unpaid fees.
These terms apply by default to all projects.
5. Usage Restrictions
AI Manipulation: The Client may not alter images using artificial intelligence or machine learning tools without our express written consent.
AI Training: Our content must not be used to train, refine, or enhance AI models or datasets.
Any unauthorised alteration or use of images may result in legal action and immediate termination of licensing rights.
6. Client Responsibilities
The Client is responsible for providing all required products, props, brand guidelines, and usage specifications.
Packshot Bureau Limited accepts no liability for damage to or loss of products supplied.
The Client is responsible for ensuring all product usage rights and releases are in place.
7. Limitation of Liability
We are not liable for any indirect, incidental, or consequential damages related to delays, loss of use, or image delivery.
Our total liability is limited to the fees paid for the specific service in question.
8. Rejection
Rejection based on creative preference, style, or composition is not accepted after delivery, unless a rejection clause was previously agreed in writing.
Any approved reshoots will be quoted and scheduled separately.
9. Confidentiality
All Client materials and communications are treated as confidential.
We will not share, publish, or otherwise disclose images prior to the Client’s public release, unless agreed.
